Terms of Service for Design Dynasty 313 DBA Designs by Diam
Welcome to Design Dynasty 313 DBA Designs by Diam ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to our website and your purchase of products or services from us.
By using our website, requesting a quote, placing an order, or purchasing our products or services, you agree to be bound by these Terms.
1. Services
Design Dynasty 313 DBA Designs by Diam provides custom event décor, balloon installations, event rentals, personalized gifts, apparel, promotional products, printing services, digital designs, and related creative services.
Because many of our products are custom-made, every order is unique.
2. Quotes and Pricing
Quotes are valid for thirty (30) days unless otherwise stated.
Prices are subject to change without notice until an order has been confirmed with the required payment.
Additional changes requested after work has begun may result in additional charges.
3. Payments
Payment terms will be stated on your invoice or contract.
Unless otherwise agreed:
A non-refundable retainer may be required to reserve your event date.
Final payment must be received before production, delivery, or installation.
Orders may be delayed or canceled if payment is not received by the required due date.
Returned payments and chargebacks remain the customer's responsibility.
4. Custom Orders
Customers are responsible for reviewing all proofs before approving production.
Approval confirms that all names, dates, spelling, colors, sizing, and other details are correct.
Once production begins, Design Dynasty 313 DBA Designs by Diam is not responsible for customer-approved errors.
Additional revisions after approval may incur additional fees.
5. Personalized Products
Because personalized items are created specifically for each customer:
Personalized products cannot be returned or exchanged unless there is an error made by Design Dynasty 313 DBA Designs by Diam.
Minor color variations may occur due to differences in printers, inks, fabrics, lighting, monitors, and manufacturing processes.
Handmade products may contain slight variations that do not constitute defects.
6. Customer-Supplied Materials
Customers may provide photographs, logos, artwork, or other content for use in custom products.
By submitting materials, the customer represents that they own or have permission to use all submitted content.
The customer agrees to indemnify and hold Design Dynasty 313 DBA Designs by Diam harmless from any copyright, trademark, privacy, or intellectual property claims arising from submitted materials.
7. Balloon Installations and Outdoor Events
Balloon décor is intended to be temporary.
Outdoor conditions—including heat, sunlight, humidity, rain, wind, and temperature changes—may cause balloons to oxidize, shrink, fade, deflate, or pop.
These conditions are outside our control and do not constitute defective workmanship.
Once installation has been completed:
We are not responsible for damage caused by weather.
We are not responsible for damage caused by guests, vendors, venue staff, or the customer.
Moving or repositioning balloon installations after setup may affect the integrity of the design.
Outdoor installations are accepted at the customer's own risk.
8. Rental Equipment
Rental items remain the property of Design Dynasty 313 DBA Designs by Diam.
Customers are responsible for rental equipment from delivery until pickup.
Damaged, missing, stolen, excessively dirty, or destroyed rental items may result in replacement or repair charges.
9. Delivery and Installation
Delivery times are estimates.
We are not responsible for delays caused by:
Traffic
Weather
Venue access restrictions
Delays caused by the customer
Venue staff
Acts beyond our reasonable control
The customer is responsible for ensuring that the installation area is available upon arrival.
Additional waiting time may incur additional fees.
10. Shipping
Once packages have been delivered to the shipping carrier, Design Dynasty 313 DBA Designs by Diam is not responsible for delays, lost packages, damaged packages, or carrier-related issues.
Customers should contact the shipping carrier directly regarding shipping claims when applicable.
11. Cancellations
Retainers and deposits are non-refundable unless otherwise stated in writing.
If the customer cancels after production has begun, the customer remains responsible for work completed, materials purchased, and labor incurred.
12. Intellectual Property
All original artwork, mockups, templates, graphics, website content, logos, photographs, and designs created by Design Dynasty 313 DBA Designs by Diam remain our intellectual property unless otherwise agreed in writing.
Customers may not reproduce, resell, modify, or distribute our designs without written permission.
Digital design files are licensed only for the purpose stated at the time of purchase.
13. Portfolio Rights
Unless otherwise agreed in writing before production begins, Design Dynasty 313 DBA Designs by Diam reserves the right to photograph and display completed products for advertising, marketing, social media, website, portfolio, competitions, and promotional purposes.
Customers requesting complete confidentiality must notify us before production begins.
14. Limitation of Liability
To the fullest extent permitted by law, Design Dynasty 313 DBA Designs by Diam shall not be liable for:
Indirect damages
Consequential damages
Lost profits
Lost event opportunities
Emotional distress
Delays caused by circumstances beyond our reasonable control
Our maximum liability shall not exceed the amount actually paid for the specific product or service giving rise to the claim.
15. Warranty Disclaimer
Except where required by law, all products and services are provided "as is" without warranties of any kind, express or implied.
16. Force Majeure
We are not responsible for delays or inability to perform caused by circumstances beyond our reasonable control, including but not limited to:
Severe weather
Natural disasters
Government actions
Power outages
Labor disputes
Supply shortages
Transportation interruptions
Public emergencies
17. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the State of Michigan, without regard to its conflict of law principles.
Any legal action arising from these Terms shall be brought in the appropriate state or federal court located in Michigan.
18. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
19. Changes to These Terms
We reserve the right to modify these Terms at any time.
Updated Terms become effective immediately upon posting on our website.
Continued use of our services constitutes acceptance of any revised Terms.
